Human oversight language shows up in AI agreements constantly, often without much thought about what it requires in practice. A clause promising meaningful human review reads well until someone asks who is doing the reviewing, at what point in the process, and whether that person has the information or the authority to change the result. Regulators have been asking versions of those same questions, particularly about automated decisions that carry legal or similarly significant effects. That leaves the drafter translating a general expectation into obligations a party can actually perform and later prove.
In this webinar, Laura Frederick, Tamra Tyree Moore, and Arohi Kashyap will walk through how to draft human oversight and meaningful human review provisions with enough specificity to be useful. They'll cover defining the oversight obligation itself, including who performs it, at what decision points, and with what qualifications. They'll take a close look at use restrictions that limit fully automated decisions with legal or significant effects, and how to write those restrictions so they line up with regulatory expectations. The speakers will also discuss records and audit approaches, including strategies for documenting review so the company can show meaningful human involvement after the fact.
