An AI provider might process customer lists, website activity, or audience segments, and the way that data moves between the parties can carry consequences under state privacy laws. Some of those laws set separate rules for sensitive personal information, treat certain disclosures as a sale or sharing of personal information, and place limits on advertising based on a consumer's activity across different sites and services. For attorneys drafting and reviewing these agreements, the practical challenge is writing provisions that reflect how the data will actually be used and that hold up if questions come up later.
